5 Surprising Laws in Ocean City, Maryland

Ocean City, Maryland is unique in many ways. From the incredible restaurants to the 10+ miles of beaches, and iconic boardwalk, there is always something new and exciting to see! Surprisingly, the town also has many unique laws that shock both visitors and locals. Here are five laws that blindside tourists and residents when they are charged.

1. Open Container on the Street 

Unlike many tourist destinations around the world, you cannot stroll down the beach or the sidewalk with a red solo cup, beer can, or any other alcoholic beverage in your hand. The local law enforcement in Ocean City specifically looks for individuals with a beverage, and they will ask you about your cup! You cannot have alcohol in an open container in any public place, including the beach, boardwalk, sidewalk. Basically, it is illegal to possess or consume alcohol in any public area. If you do find yourself in this situation, the violation can earn you up to 90 days in jail and/or a $500 fine.

2. Open Container in the Car 

If you are a driver or a passenger, having an open alcohol container in the car is enough to get you in trouble, regardless of whether anyone has actually been drinking. Violations can lead to steep fines, a court appearance, loss of driver's license, or even more serious charges, depending on the circumstances. 

3. Trespassing in a Parking Lot 

Most condos have a special trespass enforcement arrangement with the town of Ocean City. This means that local law enforcement is authorized to enforce trespassing laws on most condo properties, so even simply walking through their parking lot could result in a trespass charge. It is important to know where you are and adhere to the “No Trespassing” signs! 

4. Intoxicated Endangerment 

Walking along the road falling down drunk can earn you a charge of intoxicated endangerment. In this case, you are a danger to yourself and others. 

It is critical to use the buddy system, know your own whereabouts, and remember the condo name and unit number you are staying in. If someone in your group cannot physically walk home, call a taxi to transport them. If you cannot physically walk home or find a private ride, local law enforcement will likely transport you to the drunk tank. Once you've sobered up, call 410-600-3075.

5. Trespassing in a Local Establishment 

When you're told to leave an establishment, leave immediately or you could be charged with trespassing. The moment you are told to leave, it might be tempting to convince the bar security team that actually, you should be allowed to stay. This is a bad idea, as local law enforcement is likely already around the corner. If you are asked to leave the bar, restaurant, condo building, or other establishment, do so immediately.
